Plaintiffs' Memorandum in Opposition to Defendants' Motion to Stay This action challenges Defendants' protracted delays in implementing 2010 amendments to 42 USC 256b, which governs the program by which hospitals, community health centers, and other federally funded clinics that disproportionately鈥
Defendants hereby request that the Court (1) stay this case pending the outcome of the U.S. Department of Health and Human Services' planned rulemaking that may moot the case or limit the issues to be decided by the Court, or in the alternative, (2) stay briefing of plaintiffs' early summary鈥
Plaintiffs essentially allege that they have a statutory entitlement to a government-funded windfall with every drug purchase they make through the 340B Program, and that the Secretary erred by decreasing the amount of the windfall in the final 2018 OPPS Rule. See, e.g., Plaintiffs' Reply in鈥
